RiseCast Terms of Service

These terms cover your use of the RiseCast app and the risecast.fish website. Plain language on purpose. If anything here is unclear, email support@risecast.fish and we will explain it.

Agreeing to these terms

By creating an account or using RiseCast you agree to these terms. If you do not agree, do not use the service. If you use RiseCast on behalf of a business, you confirm you can bind that business.

Who can use RiseCast

You must be at least 13 years old. If you are under the age of majority where you live, a parent or guardian must agree to these terms with you. You are responsible for keeping your account credentials secure and for everything that happens under your account.

What RiseCast is, and what it is not

RiseCast is an information tool. It combines public conditions data with our own models to produce scores, timing windows, and fly suggestions. Those outputs are estimates and opinions, not facts and not guarantees.

• Conditions data comes from third parties (USGS, NOAA/NWS, Open-Meteo, and others). It can be delayed, incomplete, or wrong. Gauges fail. Forecasts miss.
• The Fishability Score, best-hours timeline, hatch calendar, and AI Fly Box are model output. They are frequently useful and sometimes wrong.
• RiseCast is not a safety device and not a navigation system. Do not rely on it for water safety, weather emergencies, or route finding in the backcountry.
• RiseCast does not tell you what is legal. Fishing regulations, licensing, seasons, closures, access rules, and private property boundaries are yours to verify with the relevant state agency and landowner before you fish.

You fish at your own risk. Moving water is dangerous.

Your content

You keep ownership of what you put into RiseCast: catches, photos, notes, spots, and reports. You grant us the limited licence we need to operate the service for you, meaning storing your content, backing it up, displaying it back to you, and showing it to the specific people you choose to share it with. That licence ends when you delete the content or your account.

You are responsible for having the right to upload what you upload.

Location and privacy

Spots and catch locations are private by default and enforced in our database with row level security. We do not sell your data, and we do not sell or broker access to your spots. Full detail is in the privacy policy.

Do not use RiseCast to publish someone else's private water, to trespass, or to share access you do not have.

Acceptable use

Do not:

• Break the law, fishing regulations, or access rules while using the service, or use RiseCast to help someone else do so.
• Scrape, bulk export, or resell RiseCast data, including stream classifications, scores, and conditions aggregations.
• Reverse engineer the service, attack it, or attempt to reach data that is not yours.
• Upload content that is unlawful, harassing, or infringing.
• Misrepresent conditions, catches, or locations in shared or community features.
• Use automated systems to create accounts or generate load beyond normal personal use.

We can suspend or close accounts that break these rules.

RiseCast Pro subscriptions

The core map, access points, and live conditions are free. RiseCast Pro is a paid subscription that unlocks the Fishability Score, best-hours timeline, AI Fly Box, offline regions, and journal insights.

• Subscriptions are sold and billed through the Apple App Store or Google Play, not by us directly. Their terms govern payment.
• A subscription renews automatically at the then-current price until you cancel it. Cancel any time in your store account settings, at least 24 hours before the period ends.
• Free trials convert to a paid subscription unless cancelled before the trial ends.
• Founding pricing is an introductory rate for a first-year term and renews at the standard rate stated at purchase.
• Refunds are handled by the store you purchased through, under their policies.
• Prices can change. We will give notice before a change affects a renewal.

Availability and changes

We are building this in the open and will add, change, and remove features. We may modify or discontinue parts of the service. During the closed beta in particular, expect bugs, downtime, and data model changes. We try hard not to lose your data, and you should still keep your own copies of anything irreplaceable. The export tool in Settings is there for that.

Third-party services

RiseCast relies on third parties including Supabase, Apple, Google, RevenueCat, Anthropic, Sentry, PostHog, MapTiler, and public data providers. Their outages are our outages, and their terms may also apply to you where you interact with them directly.

Disclaimer of warranties

RiseCast is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent the law allows.

Limitation of liability

To the fullest extent the law allows, RiseCast and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, personal injury, or property damage arising from your use of the service. Our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars.

Some jurisdictions do not allow these limits, in which case they apply to the extent permitted.

Indemnity

You agree to cover claims brought against us that arise from your misuse of the service, your content, or your violation of these terms or the law.

Ending your account

You can delete your account at any time in Settings. We can suspend or terminate accounts that violate these terms, that create legal risk, or where required by law. Sections that by their nature survive termination (content licences already granted for shared material, disclaimers, liability limits, indemnity) survive.

Changes to these terms

We will post changes here and update the date at the top. Material changes get notice in the app or by email. Continuing to use RiseCast after a change means you accept it.

Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law rules. Disputes go to the state or federal courts located in Delaware, and you and we consent to that jurisdiction. If the law where you live gives you the right to bring a claim locally, nothing here takes that right away.
